4. Swerved to miss something - error of judgment in doing so. I have just started reading this thread and hence I am late to the party. I am also not going to express a view one way or the other simply because none of us will have all of the relevant facts. The only ones that will go close to having all of the facts will be the decision makers at the club, so I am comfortable with running with their decision. I often see people being highly critical of judges and magistrates with their decision making, but without having all of the relevant information that is available to that decision maker when they make their decision. There are so many variables with the Mam situation. What if he was experiencing a significant mental health crisis due to a combination of factors that simply overwhelmed his coping mechanisms and he was too proud or too silly to reach out for help? We had the racial vilification incident in Las Vegas, what if that was still impacting and then on top of that he has a close relative pass away or dying with cancer? At the same time he experiences a relationship break-up (a possible explanation for the move) and he tries to cope and ease his pain by resorting to a drug. Due to the conflation of those circumstances he is also sleep deprived and in that state he makes a stupid decision to drive. In that scenario a fairly strong argument can be mounted that dismissal is not warranted. I will wait and see.
