The agent markets the house, secures a buyer and a contract is signed between the home owner and the purchaser. The contract settles and the ownership changes on the title. If thre home owner subsequently discovers the agent has done something dodgy, overcharged on commission, got a secret commission etc, as long as the purchaser is not involved, the home owner's legal recourse is against the agent under the agency agreement.
